BY ACCESSING OR USING THE AIRDROP DELIVERY PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE. --- **1. PLATFORM OVERVIEW & MARKETPLACE DISCLAIMER** Airdrop Delivery is a technology marketplace platform connecting customers with local merchants (including restaurants, retail stores, and other businesses) and independent delivery drivers, as well as third-party logistics and aggregation partners. Airdrop Delivery facilitates order placement and delivery coordination but is NOT a restaurant, food preparation entity, direct merchant, employer, or delivery company. We do not prepare, inspect, or guarantee the quality, safety, or legality of any items sold by merchants on our platform. --- **2. ELIGIBILITY & ACCOUNT REGISTRATION** - You must be at least 18 years of age to create an account and use the Service. - You must provide accurate, current, and complete information during registration. - You are responsible for maintaining the confidentiality of your account credentials. - You agree to notify us immediately of any unauthorized use of your account. - We reserve the right to suspend or terminate accounts that violate these Terms. **2A. ACCOUNT INACTIVITY, CLOSURE & YOUR RIGHT TO DELETION** - We do not automatically delete accounts. If an account is left unfinished or unused, we may mark it inactive; it remains in our records and can be reactivated. - You may close your account and request deletion of your personal data at any time using the "Request Account Deletion" option in your profile settings, or by emailing airdrop.deliveries@gmail.com. We will action verified requests within the timeframe required by applicable law (and in any event within 30 days). - Where law permits or requires, we may retain limited records after closure — for example anonymized transaction, payout and tax records, and information needed to resolve disputes, prevent fraud, or meet legal obligations. Retained records are no longer linked to your name or contact details except where the law requires otherwise. - Nothing in these Terms limits any data deletion, access or portability rights you have under applicable law, including the GDPR and the CCPA/CPRA. See our Privacy Policy for details. --- **3. INDEPENDENT CONTRACTORS & THIRD-PARTY LOGISTICS** Drivers on the Airdrop Delivery platform are independent contractors and NOT employees, agents, joint venturers, or representatives of SmartStuff2Buy LLC. Deliveries may also be fulfilled by third-party logistics partners (e.g., Shipday). Airdrop Delivery is not responsible or liable for the actions, omissions, negligence, or misconduct of independent drivers or third-party partners. --- **4. PRODUCT QUALITY, SAFETY & ALLERGEN WARNINGS** Merchants are solely responsible for the preparation, safety, labeling, and quality of all products, food, and beverages. Airdrop Delivery does not verify ingredient lists, allergen information, nutritional content, or product descriptions. If you have severe food allergies, dietary restrictions, or product concerns, you must contact the merchant directly before placing an order. Airdrop Delivery assumes no liability for adverse reactions, illnesses, injuries, or property damage caused by items delivered through our service. --- **5. RESTRICTED & AGE-GATED ITEMS — CURRENT PLATFORM POLICY** At this time, Airdrop Delivery does NOT permit merchants to list, sell, or deliver alcohol, tobacco, cannabis, vaping products, firearms, ammunition, adult content, or any other age-restricted or regulated items. This restriction is in place while we develop and implement the compliance, licensing, and verification infrastructure required by applicable federal, state, and local law. Merchants found to be offering restricted items will be removed from the platform without notice. --- **6. USER CONDUCT & PROHIBITED ACTIVITIES** You agree NOT to: - Use the Service for any unlawful, fraudulent, or harmful purpose. - Harass, abuse, threaten, or discriminate against any other platform user. - Submit false, misleading, or fraudulent orders or reviews. - Attempt to reverse-engineer, hack, or disrupt the platform. - Upload or transmit any content that is illegal, defamatory, obscene, or infringing. - Use the Service to compete with Airdrop Delivery or to harvest user data. - Misuse the reporting or blocking features. Violation of these rules may result in immediate account suspension or termination. --- **7. RIGHT TO REFUSE SERVICE** Airdrop Delivery, its owners, partner merchants, and independent delivery drivers each reserve the right to refuse service to any individual at any time for any lawful, non-discriminatory reason, including but not limited to a customer's feedback score, history of disputes, abusive behavior, or safety concerns. Refusal of service will NOT be based on race, color, religion, national origin, sex, disability, or any other protected characteristic under applicable law. --- **8. ORDERS, PAYMENTS & FEES** - All orders are subject to availability and merchant confirmation. - Pricing, delivery fees, platform fees, and applicable taxes are displayed at checkout. - Payment is processed securely by Stripe, Inc. By placing an order, you authorize the charge. - A non-refundable platform service fee is included in each transaction. - We reserve the right to cancel any order for any reason, including suspected fraud. - In-person cash payments are available for select merchants; the platform fee still applies. --- **9. INTELLECTUAL PROPERTY** - All content, trademarks, logos, and software on the Service are the property of SmartStuff2Buy LLC or its licensors. - By uploading content (photos, reviews, messages), you grant SmartStuff2Buy LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely in connection with operating the Service. - You represent that you have the rights to any content you upload. --- **10. THIRD-PARTY SERVICES & INTEGRATIONS** The Service integrates with third-party providers including Stripe (payments), Twilio (messaging), Shipday (dispatch), Square (POS), OpenStreetMap/Nominatim (mapping and geocoding), and, where background screening is used, a third-party screening provider. Your use of these services is subject to their respective terms and privacy policies. SmartStuff2Buy LLC is not responsible for the practices of these third-party services. --- **11. PRIVACY & DATA** Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Service, you consent to the collection, use, and sharing of your data as described in the Privacy Policy. --- **12. DISCLAIMERS OF WARRANTIES** THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. --- **13. LIMITATION OF LIABILITY** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTSTUFF2BUY LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. --- **14. INDEMNIFICATION** You agree to defend, indemnify, and hold harmless SmartStuff2Buy LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload or transmit through the Service. --- **15. DISPUTE RESOLUTION & ARBITRATION** Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at airdrop.deliveries@gmail.com. If unresolved within 30 days, disputes shall be resolved by binding individual arbitration (not class arbitration) under the rules of the American Arbitration Association. You waive any right to a jury trial or class-action participation against SmartStuff2Buy LLC. Note: Certain jurisdictions (including the EU and some US states) may provide additional rights. Nothing in this section limits rights you cannot waive under applicable law. If any part of this waiver, arbitration clause, or jury/class-action waiver is found unenforceable in your state or country of residence, that part is void only to the extent required, and the rest of this section remains in full effect. --- **16. GOVERNING LAW** These Terms are governed by the laws of the State of Kentucky, USA, without regard to conflict of law principles. For users outside the United States, mandatory local consumer protection laws may also apply. --- **17. AUTONOMOUS AND AI-ASSISTED FEATURES** The Service includes features that use artificial intelligence to assist you, including an AI chat assistant and AI-assisted identity/document review. These features are advisory tools only — they do not make final decisions on your behalf, and a human review step is always required before any account, payout, or status change takes effect. You are responsible for your own use of these features, including any information, instructions, or content you submit to them. Do not rely on AI-generated responses (including any estimate of pay, earnings, or eligibility) as a guarantee — always confirm specifics with our support team. --- **18. CHANGES TO TERMS** We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance. --- **19. APPLE AIRDROP & CRYPTOCURRENCY DISCLAIMERS** Airdrop Delivery is in no way affiliated with or owned by Apple. We are not providing technologies similar to Apple AirDrop. We are NOT promoting a cryptocurrency token or giving away cryptocurrency. Any reference to "airdrop" refers solely to our delivery service. --- **20.
